What Are Material Latent Defects?

Material Latent Defects are serious issues with your home that:

  • Are known to the seller
  • Are not visible or easily identified by a typical buyer or home inspector
  • May negatively impact the property's value, safety, or functionality

When Listing with Bōde

When you create your listing on the Bōde platform, we will ask if you are aware of any material latent defects.

If you are, we will:

  • Provide you with a disclosure form to complete
  • Require that you share the document with potential buyers before they make an offer

This ensures transparency and helps protect both parties during the transaction.


Examples of Material Latent Defects

  • Structural issues such as a crack in the foundation
  • A hidden mould problem not detectable without invasive inspection
  • Flooding that occurs under certain weather conditions
  • Renovations or changes made to the home without the required permits

Important Note

A material latent defect does not exist if the issue has been properly and fully resolved.
For example, if you had a foundation crack repaired by a licensed professional, that is no longer considered a latent defect.
