What if I get an offer after I have conditionally sold?
After accepting an offer, your MLS listing must be marked pending. Backup offers need a seller’s condition to remain valid if the first deal collapses.
What Happens After You Accept an Offer?
Once you sign the Purchase Agreement—either digitally or on paper—you are legally bound by that contract unless it collapses.
MLS Listing Status
After a conditional offer is accepted, your listing status will change to "Pending" on MLS.
This alerts agents that your property is conditionally sold.
- Your listing must be marked "Pending" within 48 hours of the agreement being signed.
- If your agreement was made offline, please notify Bōde immediately so we can update your listing accordingly.
Backup Offers
Having a backup offer is a smart strategy, especially if your primary offer includes conditions that could cause the deal to fall through.
The most important element of a valid backup offer is the seller’s condition:
“The acceptance of this offer is subject to the collapse of the already accepted offer collapsing.”
This ensures:
- You are not in breach of contract by accepting two offers
- You are prepared with an alternative buyer if the first deal fails
Even if the backup offer is stronger, you must proceed in the order of acceptance—deal #1 takes precedence.
If the First Deal Collapses
You are required to complete a form disclosing the collapse of the original agreement.
